Drug Crimes

Possession and sale of peyote is the act of knowingly possessing, selling, offering to sell, transferring, or offering to transport peyote, unless such activity is in connection with a legitimate religious exercise, done in a way that is not dangerous to the public health, safety or morals.

Possession and sale of a vapor releasing substance containing a toxic substance is the act of inhaling or drinking a vapor releasing substance that contains a toxic substance. This crime can also be committed by selling, transferring, or offering to sell or transfer such a substance to a person under 18 years of age.

Nitrous oxide containers; sale to minors is the act of selling, giving or delivering to a person under 18 years of age any container exclusively containing nitrous oxide, unless the person is acting in the course of his/her employment.

Possession, use, production, sale or transportation of marijuana is the act of knowingly possessing or using marijuana; possessing marijuana for sale; producing marijuana; or transporting for sale, importing into the state, selling transferring marijuana, or offering to do any of these things.

Possession, use, administration, acquisition, sale, manufacture or transportation of prescription-only drugs is the act of possessing or using such a drug without a valid prescription. This crime can be committed by possessing such drugs for sale unless the person is permitted by law to sell such drugs.

Possession, use, administration, acquisition, sale manufacture or transportation of dangerous drugs is the act of possessing or using such drug; possessing such drug for sale; possessing equipment and/or chemicals for the purpose of manufacturing such drug; manufacturing such drug; administering such drug to another person; or transporting for sale, importing into the state, selling or, transferring, such drug, or offering to do any of these things.

Manufacturing methamphetamine under circumstances that cause physical injury to a minor is the act of manufacturing methamphetamine in such a manner that someone under the age of 15 is physically injured. [Think in terms of physically harming someone under the age of 15.]

Possession, use, administration, acquisition, sale, manufacture, or transportation of a narcotic drug is the act of possessing or using such a drug; possessing such a drug for sale; possessing equipment and/or chemicals for the purpose of manufacturing such drug; manufacturing such drug; administering such drug to another person; or transporting for sale, importing into the state, selling, transferring such drug, or offering to do any of these things.

Involving or using minors in drug offenses is the act of hiring, employing or using in any way a minor to take part in a drug offense. This crime can also be committed by selling, transferring, or offering to sell or transfer to a minor any of the drugs discussed above.

Possession, use, sale, or transfer of marijuana, peyote, prescription drugs, dangerous drugs or narcotic drugs or manufacture of dangerous drugs in a drug free school zone is the act of intentionally being in a drug free school zone to sell or transfer any of these drugs; possessing any of these drugs in such a zone; or manufacturing dangerous drugs in such a zone.

Possession, manufacture, delivery, and advertisement of drug paraphernalia is the act of using, or possessing with the intention to use, drug paraphernalia. This crime can be committed by manufacturing or delivering such device; or placing an advertisement for the sale of such device.

Use of a wire communication or electronic communication in drug related transactions is the act of using a telephone or other electronic device to arrange or facilitate a drug transaction or any felony connected to a criminal street gang or racketeering.
